The problem is that most documents are not prepared correctly or the verbiage does not fit the situation.

For example: does your financial (Durable) Power of Attorney allow you to create a Trust? Does it allow you to gift to yourself or others? Apply for Medicaid or Estate Planning? And many other complications.

Last week I met a young lady that needed help for her mother. She was so happy because she thought she had covered all her bases. She had the correct POA for Health Care, Mental Health and Living Will (http://www.azag.gov/life_care/POA_HealthCare.pdf). But she had taken a Durable POA from the web (one page document) and because the one paragraph stated it covered everything she thought it meant everything.

Well, the bank we went to to get an Income Only Trust read it and said, "this does not give you the power to open or create a Trust; you need to have your mother sign one giving you permission". Except, her mother is no longer capable of signing any document and in order to qualify for State assistance this trust was needed. We were able to resolve the issue but sometimes things can go in a different direction such as needing a Guardianship/Conservator ship which is an expense that could be avoided.

Please do not go to the Web to pick a legal document that is so important. Get professional help, make sure your document is clear about your powers.

Iron sharpens iron

Have you every thought how some people rise and shine to any occasion?

I always thought it had to do with luck, being in the right place at the right time and knowing the right people.

I learned that there are three things you need in order to succeed and make it happen.

A true burning desire to succeed.

A willingness to face rejection and tribulation in order to achieve success.

A willingness to serve your community and families.

How often do we follow this path? As long the applicant is medically eligible assets can be repositioned to qualify.

There are 3 steps to get the ball rolling:

A resource assessment will be needed to determine the amount the well-spouse can keep and the applicant's reduced/repositioned (an application is made to ALTCS so that they can determine the amount).

The 2nd step is to spend down/ reposition the assets that belong to the applicant.

The 3rd step is to apply for ALTCS to start in-home care, nursing home payment, and/or assisted living/group home assistance.

One word of caution DO NOT reduce the assets until ALTCS gives you a notice with the amount the well- spouse can keep. You may have an idea of what the amount is but until ALTCS says so you could be in danger of spending more than you should have OR the applicant may not have been medically eligible to begin with.

ALTCS is great program but doing it on your own is a challenge.

Medicaid Eligibility in Arizona

Most people that need Medicaid do not know where to go for help. Others think that if you qualify for Medicaid you will be "put in a nursing home". Arizona's Medicaid is called ALTCS (Arizona Long Term Care Systems); you must meet certain criteria to meet qualifications. You must be income eligible ($2,022 gross income), resource eligible ($2,000 or less for single individuals), and meet medical eligibility. This means that the person applying for assistance must need daily assistance with bathing, getting dressed, transferring from/on bed, toilet, chair, and having a diagnosis such as dementia, Alzheimer's or other helps.

Having someone help getting through the process helps as well. An Income Only Trust is available to those with income exceeding $2,022.

The Area Agency for Aging is another avenue for assistance. Please understand that housekeeping is not a need.

ALTCS will help with in home care, doctors, hospitalizations and other needs.

Pay $10 for 60lbs of vegtables and fruit

     Market on the Move (MOM)

The Market on the Move was created to enable the supporters of The 3000 Club distribute free produce to the hungry and the needy.

The 3000 Club is a group of like-minded individuals, small business owners, volunteers and non-profit agency(ies) and organization(s) who contribute either $100, $500 or $1,000 per year or $10 per month in order to help rescue the millions of pounds of fresh fruits and vegetables that would be thrown in the landfill in Nogales, Arizona and distribute it instead for free to the needy and hungry families, especially their children.

Due to the challenging economy we are currently experiencing, thousands of families have lost their jobs. Some people with frontotemporal dementia undergo dramatic changes in their personality and become socially inappropriate, impulsive or emotionally indifferent, while others lose the ability to use and understand language.

Frontotemporal dementia is often misdiagnosed as a psychiatric problem or as Alzheimer's disease. But frontotemporal dementia tends to occur at a younger age than does Alzheimer's disease, typically between the ages of 40 and 70.

For more information about Frontotemporal Dementia, check out Mayo Clinic.

January's birthstone

Garnet is the birthstone for January. Garnet will stimulate the senses, and increase your vitality and stamina
Some of the metaphysical properties of garnet are; friendship, love and fellowship. As I continued to watch the movie, I couldn't help but think about how many time this statement rings true in so many of the people I counsel in regards to their Estate Plans. Every week I encounter folks who have been misguided, misinformed, or just plain out right lied to for the sake of someone wanting to sell a product to them. The product may even be something that could actually enhance the estate, but if it is implemented at the wrong time, it could become a detriment to the overall estate planning process. Let me share a true story with you about a couple who really go messed up by listening to the wrong advice.

Dick & Jane (names have been changed for privacy) have been married for over 45 years, have two grown children living in other states, and have lived a very prosperous and healthy life together. Recently, Dick's health took a turn for the worse, early dementia & Alzheimer's began to set in. Jane is fulfilling her spousal commitment to her husband, many well meaning friends & relatives are all willing to offer their advice on how this is going to affect her financially. One well meaning individual said that if she would start giving away the estate, she would someday be able to qualify Dick for the State & Federal government assistance programs. But she would have to take care of him for three years before she could ever request such government assistance. Jane respected this individual very much & set off to put the plan into motion. She started gifting some of her cash assets to her children, hoping that if she ever needed funds in the future, they would be more than happy to help their loving mother. Well, one long hard year now has passed & Jane is just plain worn out from the constant 24hr supervision over Dick. He is getting too much for her to handle on a daily basis, but she has to hold on for another two more years. Jane's health is now starting to take a turn for the worse, because of the wear & tear on her own body, she says "I need help & cannot continue this way!" Little did she know that the advice she was given was incorrect!

If you have an area of concern in your life that you are either dealing with or going to be dealing with, it is beneficial to speak with someone who knows what to do about whatever the situation may be, not just listening to a well meaning friend or family member. If you need heart surgery, do you go to your brother-in-law? NO... Why?...because, little does he know! There are specialists all around us in life for many different areas of concern, we need to start listening to the right voices, now back to our story.

I had the distinct pleasure of being introduced to Jane by a concerned friend who happened to be a client of ours for several years & knew from her own personal experience, how we had helped her. After listening to Jane's situation we began to formulate the correct plan of action for her. First of all, there is no look back or waiting period for gifts between spouses. There was no need to give anything to the children. Dick could have been admitted to the nursing home right away. Jane could have been spared all the additional stress & wear & tear on her body, and yes Dick's nursing home bill would be subsidized from the State and Federal government programs, thereby allowing Jane to continue living a normal financial life. "Oh, Little did she know but..."

Now Jane is able to relax knowing that the financial burden has been removed & that Dick is in the right place where properly trained people are giving him the best of care. Jane has asked that I share her story, "so others will never have to go through what I did; let them know there is an answer".

Please don't wander around in life listening to well meaning people who may have incorrect advice...

Go to the expert!

Article by Bobby King Certified Estate Planner

Arizona State Veteran Home

The Arizona State Veteran Home is one of the best kept secrets in Central Phoenix. It is a 200 bed facility that offers nursing home and short term rehab in a skilled nursing facility to Veterans and their spouses. It is a thriving facility that welcomes the surrounding community into their home. The community visits through a variety of programs. For example, on Veterans Day, over 200 visitors came to the home to thank the Veterans, assist them to the parade and share a barbecue hosted by the Phoenix Fraternal Order of Police Lodge 2 and the Vietnam Veterans of America. The Honorable Governor Janice Brewer was in attendance for an afternoon of entertainment and tribute to all who have served our country through the military. The home is a hub of activity thanks to the many volunteers who share their talents, kindness and gratitude. The Director of the Arizona Department of Veterans Services, Colonel Joey Strickland, summed it up best when he said "The Arizona State Veteran Home is a place where Veterans come to live, not to die". That statement is evident when you come to the home. At first impression you see a beautiful building with a lobby filled with veterans sitting around talking, watching TV or playing a game a pool. As you venture on you see volunteers visiting with their dogs, you may hear the birds singing from the large aviary or you may hear the caller from a game of bingo. Volunteers are the constant reminder to the Veterans who reside at the Arizona State Veteran Home that the community remembers what these elderly Vets have done for them. If you would like to thank a disabled Veteran from World War II, Korea or Vietnam please consider volunteering at the Arizona State Veteran Home. There are a variety of volunteer positions available. If you can't find one that interests you, the Volunteer Department will help create the perfect job just for you. The greatest need right now is for Volunteers to help with the Adopt A Vet program, the Family Pet Visit program and the front receptionist/greeter program. If you are available to volunteer even one day a month, please consider volunteering at the Arizona State Veteran Home. The men and women who served our Country so bravely appreciate the fact that they are not forgotten. In fact, injuries resulting from falls are a leading cause of death for older persons. Not all falls can be prevented, but many can! So, it is important to understand the risk, and to know what can be done to help protect yourself or your loved one.

SENIORS HAVE AN INCREASED RISK OF FALLING BECAUSE OF?
Physical and mental changes - Most older persons, sooner or later, will experience problems with their eyesight, sense of balance, mobility, bone structure, and reflexes. Confusion, forgetfulness, stroke, Parkinson's, and Alzheimer's are also important risk factors.

Medications - Most seniors take a variety of medications, both over-the-counter and prescription. Many medications can cause dizziness, drowsiness, or other side effects that make it harder to keep your balance.

Environmental causes - Throw rugs, electrical cords, wet and slippery floors, rough floor surfaces, slick walkways and steps, and poor lighting are all examples of things or conditions that can trip you up.

PRACTICAL SUGGESTIONS FOR PROTECTING AGAINST FALLS
Although it is unrealistic to think we can prevent all falls from happening, there are many proven ways of reducing the risk. Here are some important examples of how you can protect yourself:

Ask your doctor about setting up a fall prevention exercise program for building up your strength and coordination. A good program will include aerobic, strengthening, and flexibility exercises, as well as specialized balance training.

If you have experienced episodes of dizziness, or if you think you may have a problem with balance, vision, or your medications, talk with your doctor.

Eat right. Getting the nutrition you need is just as important as getting appropriate exercise and rest.

Be aware of your surroundings. Give yourself time to react to your physical surroundings and the other people around you, and pay special attention any time you are in new or unfamiliar surroundings.

Do a careful safety inspection of your living spaces. Look for anything that could make you trip, like rough floor surfaces, throw rugs, poor lighting, extension cords, or clutter. While you are at it, try to identify improvements that could make your situation even safer, such as extra grab bars in the bath or shower, a second hand railing on the stairs, and additional lighting indoors and out.

Make fall protection a topic for discussion with family and healthcare providers. Preventing falls is a topic that deserves time and attention!

<img width='1' height='1' Mom finally confided to Gail that she'd had an "accident" at the theater, and that she liked to be close to a bathroom at all times these days. "I guess it's just part of being old," Mom said sadly. Gail asked Mom if she'd talked to her doctor about the problem, but Mom said, "Oh no! I'd be too embarrassed!"

When an older adult is dealing with incontinence, embarrassment may stand in the way of seeking treatment.
_______________

Over 25 million Americans experience incontinence. Yet most seniors who are dealing with the condition may well feel that they are all alone, because this isn't a topic that comes up very often! Family caregivers may be the only one their loved one confides in—or their loved one might avoid discussing the issue, even when family caregivers know there is a problem.

But it is very important that the person discuss this issue with his or her healthcare provider. Left untreated, incontinence usually worsens, and can be the first step to a debilitating withdrawal from life. This in turn leads to a decrease in the basic elements of healthy aging: social connectedness, physical activity and intellectual stimulation. Incontinence causes skin irritation, interferes with sleep, and can lead to depression. It is so important to reassure loved ones and encourage them to seek help for the condition!

What is urinary incontinence?

Urinary incontinence is the inability to maintain control over the release of urine from the bladder. The causes of incontinence vary widely, as does the degree of the problem. Incontinence may be brought on by illness, fatigue, confusion, or a hospital admission. It also may be caused by weakening of the muscles which control bladder outflow, disorders of the central nervous system or obstruction to the bladder.

It is helpful to be able to distinguish between the different types of incontinence:

Urge incontinence occurs often in seniors and can be the result of neurological damage, strokes, diabetes, or the aftermath of bladder infections or kidney stones. In this circumstance, the individual does not receive a signal in time to reach the bathroom before the bladder begins to empty itself.

Overflow incontinence occurs when small amounts of urine leak from a bladder that is always full due to such conditions as obstruction, constipation or nerve damage. In men, enlarged prostate is often the cause.

Stress incontinence means the involuntary passing of urine during any increase in abdominal pressure, such as coughing, sneezing, laughing or lifting heavy objects. It is often seen in women who have had relaxation of the muscles of the pelvic floor, usually due to childbirth.

Functional incontinence occurs when a person has normal bladder control, but is unable to get to the toilet on time because of a mobility problem. Alzheimer's and other types of dementia may also be a factor; people with these conditions may not be able to think about getting to the toilet or may forget how to get there and negotiate clothing.

Can incontinence be treated?

Like Gail's mother, many people believe that incontinence is just "a normal part of growing older." But—just as with memory loss, inactivity and so many other conditions— we now know that this isn't necessarily true. Yes, incontinence becomes more common as we grow older, but in many cases, it can be treated effectively.

So at the first sign of incontinence, it is important to consult a physician to determine its cause and type. Your loved one's physician can diagnose and treat underlying diseases, check and reevaluate medications that might cause or increase incontinence, and evaluate the severity of the problem. The patient may be asked to keep a "bladder diary," recording incidents of incontinence and the amount and frequency of urination. Ultrasound and other tests provide an idea of bladder volume, as well as any blockages or other contributing factors.

A variety of treatments are available, including:

Bladder training. The patient keeps a chart of urination and leaking, and then works out a bathroom schedule, planning trips to the toilet at certain set times (for example, once an hour).

Pelvic muscle exercises, such as "Kegels," can strengthen the bladder muscles and the muscles of the pelvic floor. This helps hold urine in the bladder longer. The time can be gradually extended so that urine is held for longer periods.

Medications. Some commonly prescribed drugs stop bladder contractions; others relax the muscles to prevent urgent or frequent urination. In post-menopausal women, estrogen pills, creams or patches may be prescribed.

Surgery. While only a physician can tell if treatment would be effective for any particular case, surgery can be effective, especially in treatment of stress incontinence and incontinence due to prostate enlargement.

Lifestyle changes. The physician may recommend cutting down or eliminating caffeine, alcohol and tobacco products. All can increase incontinence by irritating the bladder.

When treatments don't completely work…

People who are living with incontinence may feel more secure wearing special absorbent, disposable undergarments which are inconspicuous and quite effective in masking the incontinence. These undergarments are sold in drug stores and supermarkets, and though they don't "solve" the problem, they may bring a sense of peace of mind and dignity to your loved one.

If mobility problems prevent the person from making it to the bathroom in time, consider having a commode chair nearby.

Specially designed clothing makes it easier for people with arthritis, stroke or Alzheimer's to negotiate fasteners in time.

How can family help?

When dealing with an incontinent loved one, tact and sensitivity are always necessary. Try not to overreact if an older family member or friend has an accident around you. Dignity is a fragile thing in all of us, and it is something we all need to maintain. This is one of those occasions in which you need to be particularly careful in your caring.

But it's also important to talk about the problem with your loved one, and encourage him or her to seek treatment. The National Association for Continence estimates that the average senior waits close to seven years to report the problem to the doctor! The sooner treatment begins, the better.

For More Information

The National Association for Continence website offers information and support for older adults and caregivers, including the Bladder and Bowel Diagnostic Tool.

The National Kidney and Urologic Diseases Information Clearinghouse website includes extensive information and resources on urinary incontinence.

70's moment

Listening to an LP (vinyl record) "Looking for Mr. Goodbar" soundtrack from 1977. My client is from out of town and her step-father passed away in March. Her mother is in a nursing home setting and is difficult. Very smart lady but stubborn as can be. My client had a power of attorney from her mother and WF said no it does not have the "verbiage" to comply in AZ. This was a POA done in AZ! WF wanted a power of attorney (their own form) giving my client the power to conduct business for the deceased signed by the mother (his widow), an Affidavit of collection (no probate needed) and the death certificate. WF gave them the form (POA) and we went to the Mariopa county self help page for the affidavit took them to the mother to sign and notarize. Daughter then takes the docs to WF and they call back saying the affidavit that was signed was not the right one; their form is required. I meet with them, read the form and it clearly says "on behalf of" and ask the daughter to sign it and put as POA for ... they go back to the bank to drop off the new form and leave to go back home. Monday afternoon she calls me because WF called her to state the Affidavit she signed was not good enough, it had to have the mother's signature. He wanted the mother to go to the bank to sign the form. I called WF spoke to the person and he says their legal department did not want the daughter to sign because it appears that she is taking the money. She was given POA on Wells Fargo's form by her mother; how in the world is she taking the money when she is trying to get the step-father's money to put into the mother's account to pay for her care? Both accounts are in the same bank! The employee told me he could not explain the reasoning and he would have the legal department call me. As of today, I have not heard from them. I called and was told the person I spoke to first is off and the bank manager would be back in an hour and would call me back. Hmmm.... no call.

Could this be one of the reasons banks are failing? They are not customer friendly and we are not talking millions of dollars here. Not even hundreds of thousands, a measly $20,000 or less after the bank charge whatever charges they can think of. Mother's cost of care is $2,500 a month, she has run out of money and daughter has started to use her 401K to pay for it. In the mean time, Wells Fargo is sitting on this money and a client might lose health care and medical care because they are worried about signatures.

Bilirubin

When bilirubin levels are high, a condition called jaundice occurs, and further testing is needed to determine the cause. It is not uncommon to see high bilirubin levels in newborns, typically 1 to 3 days old. This is sometimes called physiologic jaundice of the newborn.
Newborns: Excessive bilirubin damages developing brain cells in infants (kernicterus) and may cause mental retardation, learning and developmental disabilities, hearing loss, or eye movement problems. It is important that bilirubin in newborns does not get too high. When the level of bilirubin is above a critical threshold, special treatments are initiated to lower it. An excessive bilirubin level may result from the accelerated breakdown of red blood cells due to a blood type incompatibility between the mother and her newborn (e.g., the mother is Rh-negative and has antibody to Rh-positive blood - the father is Rh-positive, and the fetus inherits this trait from him; the mother’s antibody crosses the placenta and causes the fetal Rh-positive red blood cells to hemolyze, resulting in excessively elevated bilirubin levels with jaundice, anemia, and possible kernicterus.)

Mother's Day stats

Americans will spend an average of $123.89, compared with last year's $138.63. I met a widow today and you would not recognize her from 8 months ago when she lost her husband. I asked her how long they had been married and she stated 50 years, ...days and so many hours. She stopped eating, seeing friends and wanted to sleep herself away. It was only because she got so sick and ended up in the hospital that she is asking for help.

One of the many things I have learned from working with seniors is, don't wait until it is too late to tell someone you love them. It doesn't matter how old you are or what circumstances you are in. Life passes you by and before you know it, it is over.

Prepare your pre-need plans ahead of time and let your loved one know your wishes.
